The Transfer of Undertakings (Protection of Employment) Regulations 2006 were implemented in order to provide greater certainty and security to employees throughout the process of business transfers. However, the regulations have been criticised for forcing employers to comply with onerous obligations, with failure to do so leading to potentially large financial and reputational losses. Because of the intricacies of TUPE and potential detriment of non-compliance, it is essential to keep abreast of this constantly changing area of law.
