Implementation of the Jackson report into civil litigation funding will have a seismic impact on personal injury costs. The Government is planning to adopt most of Lord Justice Jackson’s recommendations, including abolishing the recoverability of CFA success fees and ATE premiums, which are now the dominant form of claimant funding in personal injury and clinical negligence cases.
