Clinical negligence update 2012

Funding of clinical negligence cases is undergoing seismic changes as part of the wider costs reform. Our eminent speakers will explore their practical repercussions.

The Legal Aid, Sentencing and Punishment of Offenders Act 2012 removed legal aid provisions for most clinical negligence cases with a number of important exceptions. Legal aid will be available for babies who suffer severe neurological damage at birth leading to permanent disability. It will also continue to cover the cost of obtaining medical reports. These changes remain controversial as many commentators believe that they are highly political. They allow the Government to cut its legal bill, whilst putting the disabled and vulnerable at a disadvantage.
