Part 36 and settling claims

It is expected that Part 36 will be redrafted to go with the recommendations made by Lord Justice Jackson, which aim ‘to equalise the incentives between claimants and defendants to make and accept reasonable offers’. It has been recommended that claimants should be given an incentive to make Part 36 offers, meaning that they will gain 10% more damages if the offer is not beaten. It will also be made clear that where an offer is beaten at trial by however a small margin, the costs sanctions applicable under Part 36 will apply.
